USSC and Reduction in Sentences/Compassionate Releases

The United States Sentencing Commission recently released data on Reduction in Sentence(s), more commonly known as Compassionate Releases. Although the number of such Reduction in Sentences have decreased from the height of the COVID 19 Pandemic when COVID-19 placed a great number of inmates at risk of death, it appears that most courts are quite active in approving such requests for a multitude of reasons. Generally, a court must find that there are "extraordinary and compelling" reasons to grant such a request. As well, medical reasons, terminal illnesses and the like are also well considered by the federal judiciary. In addition it appears that courts also consider the length of the sentence, multiple stacking of sentences, rehabilitation, prison conduct, safety valve disqualification, family circumstances and sentencing errors.
